Digital asset transactions are processed directly by the Service Provider via a licensed Virtual Asset Service Provider gateway.

3. NATURE OF GOODS AND SERVICES
The Platform provides access to digital services and content. All payments made through the Platform are commercial transactions for the purchase of:
- Digital Content License: A non-exclusive, revocable, non-transferable license to access premium audiovisual content, archives, and exclusive media streams.
- Interactive Software Features: Fees paid for triggering real-time software events (e.g., on-screen visual alerts, text-to-speech synthesis, media requests) via our application API.
- App Functionality: Subscription fees for access to premium tools within our proprietary software.
No Charitable Donation: You acknowledge that your payment is not a charitable donation or gift, but a fee for digital services rendered.
4. PRICING, TAXES, AND CURRENCY
- Pricing: All prices are displayed in USD, EUR, or the applicable local currency at the time of the transaction.
- Taxes (VAT/Sales Tax):
- For transactions processed by Paddle, applicable VAT or Sales Tax is calculated, collected, and remitted to local tax authorities by Paddle.com automatically.
- For transactions processed by the Georgian Entity (Crypto), prices are inclusive of applicable taxes under Georgian Law.
- Crypto Network Fees: The User is responsible for any blockchain network fees (gas fees) associated with cryptocurrency transfers.
5. REFUND POLICY (RIGHT OF WITHDRAWAL)
5.1. Digital Goods Exemption
By purchasing digital content or interactive services, you expressly consent to the immediate performance of the contract. You acknowledge that you lose your right of withdrawal (cooling-off period) once the digital content has been accessed or the service (e.g., live alert) has been executed. Generally, all sales are final.
5.2. Exceptions
Refunds may be granted at the sole discretion of the Service Provider or Paddle.com strictly in cases of:
- Technical failure where the content was not delivered.
- Duplicate payment due to a verified technical error.

6. USER CONDUCT AND AML POLICY
To prevent financial crime and ensure compliance with banking regulations (AML/KYC), you agree that:
- Source of Funds: The funds used for payment belong to you and are not derived from illegal activities.
- Sanctions Compliance: You are not located in, or a resident of, any country subject to comprehensive international sanctions that would prohibit this transaction.
- Content Standards: When utilizing interactive features (e.g., sending a message with payment), you agree not to submit content that includes hate speech, harassment, illegal materials, or threats. We reserve the right to block such content without refunding the transaction fee.
7. INTELLECTUAL PROPERTY
All content provided on the Platform, including video streams, software code, graphics, and audio, is the intellectual property of P/E Evgenii Cherniakhovskii or licensed to us. Purchasing access does not grant you ownership rights to the underlying content or software.
8. DISCLAIMER OF WARRANTIES
The services are provided on an "as is" and "as available" basis. We do not guarantee that the live stream or application will be uninterrupted, error-free, or compatible with all devices. We are not responsible for delays caused by third-party platforms or blockchain network congestion.
9. GOVERNING LAW AND DISPUTE RESOLUTION
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of Georgia.
- Dispute Resolution: Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Georgia.
- Paddle Transactions: Disputes regarding the payment processing of card transactions may also be subject to Paddle's Buyer Terms and Conditions.
